(hereinafter referred to as “MAILERFIND”, “we“, “our“, “us“), wishes to offer you as a user (hereinafter referred to as the “User“, “you“, “you” and “yours“) a secure experience and service in our web environment located at the address https://mailerfind.com (hereinafter referred to as the “Website“).

    For this reason, we have implemented this Legal Notice, which complies with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (“LSSICE”), in order to regulate your access, browsing and use of the Website, as well as to inform you of your rights and obligations in relation to the content shown therein and the responsibilities that may arise from its use.

    In addition, it is important to bear in mind that we comply with the regulations established by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter, the “GDPR”) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDGDD”), which provide comprehensive protection for personal data.

  3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

    MAILERFIND is the owner or, where appropriate, has the corresponding licenses, of the intellectual, industrial, image or any other similar property rights over the Website, as well as over all the content offered therein, including, but not limited to, the source code and programming, designs, navigation structure, the photographs, illustrations, logos, trademarks, graphics, interfaces, or any other information or content contained therein.

    It is strictly forbidden to modify, copy, distribute, frame, reproduce, republish, download, extract, display, publish, transfer or sell, either in whole or in part, any content of the Website without the prior written authorization of MAILERFIND. As a User, you only have a non-exclusive right of use, strictly domestic, to browse and enjoy our services through the Website in accordance with this Legal Notice.

MAILERFIND has the authority to remove comments and contributions that violate the dignity of persons, are discriminatory, xenophobic, racist or that threaten the well-being of young people or children, public order or security, or that are considered inappropriate for publication, provided that MAILERFIND has reliable evidence of such circumstances. In any case, MAILERFIND is not responsible for the opinions expressed by any user through the publication spaces integrated into its Website, chats or other participation tools.

    If the User becomes aware of the publication of any inaccurate, outdated, false information, or of the existence of any illegal content or that could constitute a violation of intellectual property rights, applicable data protection laws and/or any other right, the User must immediately notify MAILERFIND ([email protected]) so that appropriate action can be taken.

    Likewise, MAILERFIND reserves the right to suspend, modify, restrict or interrupt, temporarily or permanently, the access, browsing, use, hosting and/or downloading of content and/or use of the services of the Website, with or without prior notice, to users who contravene any of the provisions detailed in this Legal Notice, without the possibility of claiming compensation for this reason.

  5. RESPONSIBILITIES AND WARRANTIES

    MAILERFIND cannot guarantee the reliability, usefulness or veracity of all the information contained on the Website, nor the usefulness or veracity of the content made available to users through it. Consequently, MAILERFIND does not warrant and is not responsible for:

    1. The continuity of the contents of the Website;
    2. The absence of errors in said content;
    3. The absence of viruses, Trojan horses, worms, logic bombs and/or other malicious or technologically harmful components on the Website or on the server that supplies it;
    4. The invulnerability of the Website and/or the impossibility of violating the security measures adopted therein;
    5. The lack of usefulness or performance of the contents of the Website;
    6. The failures of the Website caused by any type of attack on its servers or those of third-party service providers of MAILERFIND, as well as technical or system security failures of any of these providers that hinder the operation of the Website;

    MAILERFIND does not authorise the publication of any link that redirects to the Website on other websites that contain materials, information or content that is illegal, illicit, degrading, obscene, contrary to the law, morality, public order or generally accepted social norms. MAILERFIND does not have the power, technical means, or human resources, to know, control or approve all the information, content, products or services provided by other websites that have published links that redirect to the Website. Accordingly, MAILERFIND shall not assume any liability whatsoever for any aspect relating to websites that publish such a web link.

    In any case, MAILERFIND reserves the right to prohibit links that redirect to the Website and request their removal when they do not comply with the conditions stipulated in this section.

    All the clauses of this Legal Notice must be interpreted independently, and the rest of the clauses will not be affected in the event that one of them has been declared null and void by a court ruling or final arbitration decision. The affected clause or clauses will be replaced by another or others that retain the effects sought by this Legal Notice.

    You hereby, to the fullest extent permitted by law, agree to defend, indemnify, and hold us harmless and hold us, including our respective directors, directors, employees, partners, representatives, successors, and assigns, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees and other legal costs, brought by any third party as a result of your use of the Website.

  11. GOVERNING LAW AND JURISDICTION

    The applicable regulations will determine the laws that must govern and the jurisdiction that must be competent for the relations between MAILERFIND and its users. However, provided that said regulations provide for the possibility for the parties to submit to a specific jurisdiction, for any litigious matter arising from or related to this Website, the Spanish legislation in force at the time of the dispute will be applicable. Likewise, to the fullest extent permitted by law, MAILERFIND and its users, expressly waiving any other jurisdiction that may correspond to them, submit to the Courts and Tribunals of the city of Barcelona.
